01Acceptance of these terms

By visiting spinxpro.com, creating an account, signing up for our email list, or placing an order, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, please do not use the site or purchase the product.

You must be at least 18 years old (or the age of majority in your jurisdiction) to make a purchase. By placing an order, you confirm you are at least 18 years old and authorized to use the payment method provided.

02Who you're agreeing with

"SPINX," "we," "us," and "our" refer to PICTEK Inc., a Florida corporation doing business as SPINX, located at 7495 Atlantic Ave, #200118, Delray Beach, FL 33446, USA.

03Products & pricing

SPINX is a patent-protected anti-adhesion coating spray for pickleball paddles. We do our best to display the product accurately, but small variations in color, packaging, and ingredient concentration ranges are normal and not grounds for return outside our standard 30-day window.

All prices are listed in US dollars and exclude applicable sales tax. We collect sales tax in jurisdictions where required by law. Sales tax is calculated at checkout based on your shipping address.

Prices are subject to change at any time without notice. Promotional pricing and discount codes are valid only for the time period specified. We reserve the right to refuse or cancel orders where pricing was incorrectly displayed due to typographical error.

04Orders & cancellations

An order placed through the site is an offer to buy, which we accept by sending the order confirmation email. We reserve the right to refuse or cancel orders for any reason, including but not limited to suspected fraud, unauthorized use of payment methods, or product unavailability.

You may cancel an unshipped order by emailing hello@spinxpro.com with your order number. Once an order has shipped, it's subject to our standard return policy.

05Subscriptions / Auto-Ship

SPINX may offer a recurring delivery option ("Auto-Ship" or "Subscription") that ships SPINX to you automatically at intervals you select (e.g., every 60 or 90 days). The following terms apply to all subscription orders:

How subscriptions work

• You choose the delivery interval at checkout. We'll ship and bill you on that recurring schedule until you cancel.
• The first shipment ships immediately. Subsequent shipments process on the recurring schedule.
• Subscription pricing may differ from one-time purchase pricing (typically a discount in exchange for the recurring commitment). The price you see at checkout is the price you'll pay on each recurring shipment unless we notify you of a price change in advance.

Cancelling or pausing

• You can cancel or pause your subscription at any time through your account at spinxpro.com or by emailing hello@spinxpro.com.
• Cancellation takes effect for the next scheduled shipment. Any shipment that has already been processed for billing or fulfillment cannot be cancelled.
• To avoid an unwanted shipment, please cancel at least 24 hours before your next scheduled shipment date.

Price changes

If we change the price of subscription items, we'll notify you by email at least 14 days before the new price applies to your next shipment. You can cancel at any time before the new price takes effect.

Failed payments

If a recurring payment fails, we'll attempt to charge the card on file up to three additional times over the following week. If all attempts fail, we'll pause the subscription and email you to update your payment method.

Refunds on subscription orders

Subscription orders are subject to our standard 30-day return policy from the delivery date of each individual shipment.

06Shipping, returns, refunds

Shipping, returns, and refunds are governed by our Shipping & Returns policy, which is incorporated into these Terms of Service by reference.

07Use of the product

SPINX is engineered for application to pickleball paddle faces for paddle surface care. Use as directed on the product label.

SPINX is not intended for human consumption, application to skin as a primary use, or use on materials other than sport paddle composites. SPINX makes no medical, antimicrobial, antibacterial, or therapeutic claims.

You assume responsibility for proper use of the product. We are not liable for damage caused by misuse, including but not limited to: ingestion, eye contact, application to materials not intended for use, or modification of the formula.

08Intellectual property

The SPINX name, the SPINX logo, the "Engineered for the edge" tagline, all product imagery, and all website content are the intellectual property of PICTEK Inc. All rights reserved.

The active SPINX coating chemistry is protected by U.S. Patent 12,084,808. PICTEK Inc. holds the exclusive license to apply this patent across the entire sports category. You can verify on USPTO.

You may not reproduce, distribute, modify, or create derivative works of any SPINX content without our prior written permission. You may not reverse-engineer, reformulate, or attempt to replicate the SPINX coating chemistry.

09User-generated content

If you submit reviews, photos, comments, social media tags, or other content related to SPINX (collectively, "User Content"), you grant PICTEK Inc. a non-exclusive, royalty-free, worldwide license to use, display, reproduce, and modify the User Content for marketing, advertising, and promotional purposes, with attribution where reasonable.

You represent that your User Content is your own original work, does not infringe any third-party rights, and does not contain unlawful or harmful material.

10Warranty disclaimer

SPINX is sold "as is." We make no warranties, express or implied, beyond the 30-day satisfaction guarantee described in our Shipping & Returns policy. We disclaim all implied warranties of merchantability, fitness for a particular purpose, and non-infringement to the maximum extent permitted by law.

Specific claims about product performance (e.g., "preserves grit and spin retention," "reduces buildup," "carbon fiber safe," "match after match") are good-faith representations based on our engineering and testing, not guarantees of identical results in every use case. Real-world performance varies based on play frequency, environmental conditions, and paddle composition.

11Limitation of liability

To the maximum extent permitted by law, PICTEK Inc.'s total liability to you for any claim arising out of or relating to these Terms or the SPINX product shall not exceed the amount you paid us in the 12 months preceding the claim.

In no event shall PICTEK Inc. be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to lost profits, lost data, or damage to paddles or other property, arising out of or related to your use of the SPINX product or website.

12Indemnification

You agree to indemnify, defend, and hold harmless PICTEK Inc., its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of: (a) your violation of these Terms; (b) your misuse of the SPINX product; (c) your violation of any third-party rights; or (d) any User Content you submit.

13Governing law & disputes

These Terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-law principles. Any dispute arising out of or related to these Terms or the SPINX product shall be resolved exclusively in the state or federal courts located in Palm Beach County, Florida, and you consent to the jurisdiction of such courts.

If any provision of these Terms is found to be unenforceable, the remaining provisions remain in full force and effect.

14Changes to these terms

We may update these Terms of Service periodically. When we do, we'll update the "Last updated" date at the top of this page. For material changes, we'll notify you by email if you're on our mailing list or with a banner on the site for at least 14 days before the change takes effect. Continued use of the site or product after a Terms update constitutes acceptance of the updated Terms.
